The EB-5 Immigrant Investor Program is a U.S. visa program that allows foreign investors to obtain permanent residency (a green card) by investing in a U.S. business that creates jobs. 

Key Requirements

  • Investment Amount

    • $1,050,000 for a standard investment.
    • $800,000 if the investment is in a Targeted Employment Area (TEA), which includes rural areas or regions with high unemployment, or in qualifying infrastructure projects.
  • Job Creation: The investment must create or preserve at least 10 full-time jobs (35+ hours per week) for qualifying U.S. workers within two years.
  • New Commercial Enterprise: The investment must be in a for-profit business established after November 29, 1990, or an older business that is significantly restructured or expanded (e.g., a 40% increase in net worth or employees).
  • Source of Funds: Investors must prove that the funds were obtained legally.

Options for Investment

  • Direct Investment: Investors manage their own business and directly create the required jobs.
  • Regional Center Program: Investors pool funds into USCIS-approved regional centers, which manage projects (often real estate or infrastructure). Jobs can be created indirectly through economic activity, making this a popular choice. 

Trump’s Proposed “Gold Card”

  • In February 2025, President Trump proposed replacing EB-5 with a “Trump Gold Card” costing $5 million, aiming to raise significant funds (potentially over $1 trillion based on alleged 200,000 applicants) for U.S. job creation and debt reduction. Details remain unclear, and it’s uncertain if this will proceed or fully replace EB-5.
